We would much rather inform you about one of our new collections, or spend our time working to meet your project’s deadline and leading the Majestic Mirror team, but you may have heard something that is an unfortunate distraction.
As many of you already know, Electric Mirror, LLC, has been touting its patents for many years. Majestic Mirror & Frame successfully challenged two of Electric Mirror’s patents, D547,071 and D536,881 (click here to see attached), with the U.S. Patent & Trademark Office (“USPTO”). The USPTO invalidated both patents on the basis that there was nothing novel or innovative about them. Despite these rulings, we have learned that as of today, Electric Mirror is still falsely listing the invalidated D547,071 and D536,881 patents on its websites, in blatant violation of Federal patent law. 35 U.S.C. § 292 (“False marking” statute).
Electric Mirror recently filed a complaint for patent infringement against several companies in the industry, including Majestic Mirror & Frame, related to five patents claiming basic mirror designs. Once again, Majestic Mirror & Frame believes that its products do not infringe and/or that the five patents are invalid. Majestic Mirror & Frame intends to vigorously defend itself against Electric Mirror.
Majestic Mirror & Frame values and respects valid intellectual property rights as being vital to a healthy and competitive marketplace. Aggressive assertion of ill-gotten and invalid patents, however, serve only to intimidate companies against innovating and to stifle valid competition. Majestic Mirror & Frame adamantly contends that its products do not infringe any valid patents. In all cases where it is confronted with wrongful claims, for itself and for the future of the industry, Majestic Mirror & Frame will aggressively pursue the cancellation of any invalid patents asserted against the company.
